GENERAL TERMS AND CONDITIONS OF RENTAL
Bikecenter Paul van Hal – mountain bike rental
Version November 2026
(Translation for your convenience. The Dutch text is the binding version.)
1. Applicability
1.1 These terms apply to all bookings and rental agreements for (electric) mountain bikes, bicycles and related items of Bikecenter Paul van Hal ("the lessor").
1.2 By booking, the renter declares to have read and accepted these terms.
1.3 Mandatory consumer law always applies. If a provision is invalid as a result, the remaining provisions remain in force.
2. Booking, payment and confirmation
2.1 Bookings are made online via the booking form. All prices are in euros and include VAT.
2.2 After your booking you will receive a confirmation from the lessor with the details of your booking, the pick-up location and the payment instructions.
2.3 You pay the rental fee and any deposit at the time and in the way stated in the confirmation. If you do not pay within the period stated in the confirmation, the booking may lapse.
2.4 You will receive the type and size you booked. If this is unexpectedly not possible, we will offer an equivalent bike. If you do not want it, you will receive your payment back.
3. Pick-up and instructions
3.1 Pick up the bike at the chosen location from the start of your time slot. On request you show a valid proof of identity.
3.2 You will receive instructions about the bike and, for an electric bike, about operating it. If necessary we adjust the bike and the helmet with you.
3.3 Check the bike before you leave and report defects or problems before departure. If you report nothing, the bike is deemed to have been handed over in good condition.
4. Use and safety
4.1 You declare that you have the fitness and health to mountain bike or cycle safely, and you cycle at your own risk to the extent the law allows.
4.2 You observe the traffic rules and the rules of nature reserves, routes and trails. Adapt your riding to your own experience, the weather and the condition of the terrain.
4.3 On the constructed mountain bike routes you always wear a helmet. When renting a mountain bike, the lessor provides a helmet free of charge.
4.4 Use the bike only for recreational cycling, and only yourself. Use for competitions or commercial purposes, or by anyone other than the renter, is only permitted if the lessor has agreed in advance.
4.5 Children under 18 rent and ride under the responsibility of a parent or guardian, who accepts these terms on behalf of the child.
4.6 The bikes always remain the property of the lessor. Modifying, reselling, subletting or pledging them is not permitted.
4.7 The lessor is not responsible for the condition of mountain bike trails and cycling routes.
5. Returning
5.1 Return the bike and the helmet within the rental period to the pick-up location, unless you have agreed otherwise with the lessor.
5.2 If this is not possible, contact us as soon as possible. If the renter returns the bike late, the lessor may charge a further rental period, unless agreed otherwise.
5.3 If the renter returns the bike earlier than agreed, there is no right to a refund. In special cases the lessor may decide on compensation; we assess this case by case.
6. Breakdown, damage, theft and loss
6.1 If you have a breakdown or a defect with the bike on the way, please contact us and we will find a suitable solution together.
6.2 Damage from a fall or other causes beyond normal wear and tear is reported when you return the bike. The damage is assessed in your presence and you pay the costs immediately. A deposit that has been paid is set off against these costs.
6.3 You pay nothing for normal wear and tear.
6.4 You submit the damage invoice to your own insurer. The lessor does not negotiate with insurers.
6.5 In case of theft or loss of the bike during the rental period you compensate the damage. Therefore never leave the bike unattended and unlocked.
6.6 If you rent a gravel bike, you agree to replace or repair a flat tyre yourself during your ride. If you cannot, the lessor can come to you; costs will be charged for this and the lessor cannot guarantee how quickly they will arrive. The lessor can provide a spare inner tube; a used inner tube will be charged.
7. Liability
The lessor is not liable for damage or injury arising from the use of the rented bike. This does not apply in case of intent or deliberate recklessness of the lessor, nor to the extent that the law mandatorily prescribes liability.
8. Cancelling and changing
8.1 If you cancel a booking, the lessor charges cancellation costs as a percentage of the rental fee, depending on the number of days before the rental day:
- 31 days or more: 10%
- 8 up to and including 30 days: 30%
- 4 up to and including 7 days: 50%
- 2 and 3 days: 90%
- 1 day or less: 100%
8.2 The statutory right of withdrawal does not apply, because this is a leisure service on a fixed date.
8.3 Moving a booking is possible in consultation, depending on availability.
9. Bad weather and special circumstances
9.1 In case of storm, rain, thunderstorms or poor route conditions you can contact us on the rental day to move your booking. The lessor may also contact you to move the booking.
9.2 A refund is not possible in that case. In special cases the lessor may decide on financial compensation; we assess this case by case.
9.3 If the lessor cancels a booking itself, you will receive a new date or your payment back.
10. Ride card and gift card
10.1 A ride card entitles you to 6 rides with the type of bike and rental duration shown on the card, for the price of 5. One ride is deducted per bike, also if you rent for a shorter time. If you rent for longer, you only pay the difference.
10.2 A ride card and a gift card are valid for 2 years from the date of purchase. A ride card is personal.
10.3 If you buy a ride card or gift card online, you have a 14-day cooling-off period. If you have already used a ride during that period, you pay for that ride.
10.4 After the cooling-off period, unused rides and credit are not refunded and cannot be exchanged for cash.
10.5 Cancelling or rescheduling a booking paid with a ride card is possible in consultation.
10.6 Rides paid with a ride card do not count towards other savings or discount schemes.
11. Privacy
The lessor uses your data for the booking, the administration and contact about the rental, and keeps them as long as necessary for the administration and in accordance with statutory retention periods. Your data are not shared with third parties, except when necessary for the performance of the agreement (for example a payment provider) or required by law. You can request access to, correction or deletion of your data via info@bcpvh.nl.
12. Complaints and applicable law
12.1 If you have a complaint, report it as soon as possible, preferably during the rental period, so that we can find a solution together.
12.2 Dutch law applies to these terms and to every agreement. Disputes are submitted to the competent court.
